## PREAMBLE

This work exists because its Author created it. The Author published it first, publicly, with cryptographic proof of the date and content. No external authority was consulted, because none is needed: the proof is in the public record, verifiable by anyone with standard tools, arguable by no one.


This license treats publication as the claim. The timestamp is the patent. The hash is the seal. Maintenance is the internet itself.

## II. PATENT CLAIM BY PUBLIC RECORD


This publication constitutes a **public, timestamped, cryptographically verifiable patent claim** over the Work as a whole. This claim covers all content that qualifies as IP and is not already owned, claimed, or publicly disclosed by another.

The **Merkle root hash** covers every file in this Work as a single, indivisible unit. Altering, adding, or removing any file invalidates the root. This means the Work is protected as a whole — not file by file, but as the complete body of creation it constitutes.

The **RFC 3161 timestamp token** is signed by an independent Time Stamping Authority and is verifiable by anyone using OpenSSL. It proves that the Merkle root — and therefore the exact content of every file — existed at the stated time. This standard has been in production for over 25 years and is legally admissible under EU eIDAS (Articles 41–42) and US Federal Rules of Evidence (901(b)(9)).

For the Author's original contribution, the public record establishes when the Work was published and what the Work contained at that time. That is the claim, and it is independently verifiable.

**No permission is granted. No rights are transferred. No use is authorized.**

No individual, corporation, organization, government, institution, or automated system may:

- Copy, reproduce, mirror, scrape, cache, or redistribute the Work.
- Create derivative works, adaptations, translations, or modifications.
- Use, implement, manufacture, or commercialize any idea, method, process, system, formula, algorithm, architecture, or design described in or embodied by the Work.
- Train machine learning models, language models, or any computational system on the Work.
- Reverse-engineer, decompile, reconstruct, or independently re-derive the functional principles of the Work based on exposure to it.
- Reference, cite, or incorporate the Work into any product, service, publication, or system without the Author's explicit written permission.

### On the Idea/Expression Distinction

This license does not recognize the legal convention that ideas, once publicly described, become free for anyone to use while only "expression" remains protected.

The Author's position: **the idea is inseparable from its originator.** If the Author conceived, developed, and published it — the idea is the Author's, the expression is the Author's, and no legal fiction that rewards the reader over the creator will be honored here.

Publication is proof of authorship, not relinquishment of ownership. Visibility is not permission.

## IV. DEFENSIVE PUBLIC RECORD

Simultaneously, this publication establishes a **defensive public record**.

Should any third party file a patent, utility model, design registration, or any intellectual property claim over any concept, method, or system described in this Work, this public record exists to challenge, defeat, or narrow that later claim because the work was already publicly disclosed here.

For the Author's original contribution, the record is public, the hash is verifiable, and no examiner is required.

## V. DURATION AND MAINTENANCE

## VI. GOOD-FAITH CORRECTION AND RESTITUTION

If, due to a reasonable mistake by myself or the public, any portion of this work is later found to have been rightfully owned, already claimed, or already publicly disclosed by another, and I have benefited from it (including via the ValueFlow system or other documented means), I commit to transferring an objectively estimated share of those benefits to the rightful owner. This commitment reflects the principle that both I and the public acted in good faith based on the best available knowledge at the time of disclosure.

This correction rule concerns good-faith overlap in protectable original work. It does not replace ordinary third-party dependency, open-source, asset, or library compliance, which remains governed by the applicable terms for those materials.

This license does not expire. There are no renewal fees, maintenance payments, or lapse conditions. The claim persists for as long as the public record is accessible.

## VII. ENFORCEMENT

The Author does not depend on courts, examiners, juries, or bureaucracies to validate this claim. The claim is self-evident from the public record and independently verifiable by anyone.

However, should any party infringe, the Author reserves:

- Every legal remedy available under copyright law, trade secret law, unfair competition statutes, and any other applicable framework in any jurisdiction.
- The right to publicly identify the infringement and the infringer as part of the same permanent public record that establishes authorship.
- The right to pursue remedies under legal frameworks that do not yet exist but that a more rational civilization will inevitably establish to honor provenance over bureaucracy.

## VIII. SUBMISSION AS CONSENT

If this Work was registered through a timestamping service (such as Stamped, ProofForge, or equivalent): **the act of submission constituted the Author's consent** to timestamp the content, generate the Merkle root, and apply this license. No further authorization was needed, requested, or given.

## IX. SEVERABILITY

If any provision of this license is found unenforceable in any jurisdiction, all remaining provisions remain in full effect. A broken system's inability to recognize a valid claim does not weaken the claim.

By accessing, reading, downloading, forking, cloning, or otherwise interacting with the Work, you acknowledge the Author's claim of authorship and origin. You are not granted any rights. Contact the Author directly for permissions.

## HOW TO USE THIS LICENSE

1. Place this file as `LICENSE` in the root of your repository or project.
2. Run the manual timestamp process from `VERIFY.md` or add `.github/workflows/timestamp.yml` for automated timestamping.
3. Fill in the proof table in Section II with your actual hashes and dates.
4. Your first commit is your claim. The timestamp seals it. Done.
